(en français) 12 Juin 2006 Abus ou protection ? La réforme de la faillite des consommateurs aux Etats-Unis Personal Bankruptcy : The US Experience. US personal bankruptcy law recently changed from favoring debtors to favoring creditors. This paper examines the economic justification for personal bankruptcy, which is to provide partial wealth insurance to debtors. I also examine the effects of bankruptcy policy on the availability of credit, the number of bankruptcy filings, and the probability of self-employment. The effects of the recent U.S. bankruptcy reform are also considered.
